In a landmark verdict that underscores the enduring fight for justice in sexual abuse cases, a New York jury has awarded a staggering $1.68 billion to 40 women who accused filmmaker James Toback of sexual abuse. The award includes $280 million in compensatory damages and $1.4 billion in punitive damages, making it one of the largest such judgments in state history.
The lawsuit was filed under New York’s Adult Survivors Act, which allowed a one-year window for survivors of sexual abuse to pursue civil litigation, regardless of when the abuse occurred. This case has become a defining example of how the law can be used to challenge even the most powerful alleged abusers.
The women, many of whom were aspiring actresses, testified that Toback used his status in the film industry to lure them under false pretenses, only to subject them to degrading and coercive sexual acts. The abuse spanned from 1979 to 2014, with allegations involving manipulation, threats, and unwanted sexual advances. Toback did not appear in court and was held liable in a default judgment, which paved the way for the jury to determine damages.
