Harvey Weinstein, the disgraced Hollywood mogul and former powerhouse producer, is set to be tried for a third time in New York following a mistrial in June on rape charges involving former actor Jessica Mann. Judge Curtis Farber, presiding over the case, announced that the retrial should take place before the end of 2025, underscoring the state’s continued pursuit of justice for survivors.
In June, a New York jury found Weinstein guilty of sexually assaulting Miriam Haley, a former "Project Runway" assistant, in 2006, while acquitting him of charges brought by Polish former model Kaja Sokola. However, the jury could not reach a consensus on Mann’s allegation that Weinstein raped her, prompting the judge to declare a mistrial on that charge.
Weinstein’s sentencing for the conviction involving Haley is currently scheduled for September 30. However, Judge Farber has made it clear that he will delay the sentencing until the Mann case is retried—unless Weinstein pleads guilty or the charge is dropped.
Weinstein’s legal team, led by attorney Arthur Aidala, has publicly urged prosecutors to abandon the Mann case, suggesting that an additional conviction would not meaningfully impact Weinstein’s overall sentencing. Aidala further stated that Weinstein refuses to plead guilty because he does not want the term “rape” associated with his name.
Throughout the previous trials, Weinstein’s defense attorneys characterized the encounters with all three women as consensual and painted the survivors as opportunists—arguments that have been widely condemned by survivor advocates and women’s rights organizations.
The mistrial stemmed from tensions during jury deliberations. The jury foreman reported that another juror had threatened him, saying, “You know me; you going to see me outside.” After this confrontation, the foreman refused to deliberate further on Mann’s charge, forcing the prosecution to seek a mistrial.
Harvey Weinstein was first convicted in New York in 2020 of rape and a criminal sexual act and sentenced to 23 years in prison. That conviction was seen as a defining moment in the #MeToo movement, which launched a global reckoning around sexual violence and accountability. However, in 2024, the New York Court of Appeals overturned that conviction, citing judicial error for allowing testimony from women whose allegations were not part of the original charges.
Separately, Weinstein was convicted in Los Angeles of sexual assault and sentenced to 16 years in prison. He is currently appealing that conviction while being held at Rikers Island.
